1. Introduction

This website, located at Axelic.com, is operated by Axelic ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our website and the purchase of any products from us. By visiting our website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the website.

Please read these Terms together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, which together form the agreement between you and us.

2. Definitions

In these Terms, "you" and "your" refer to the person accessing the website or placing an order. "Products" means the goods offered for sale on the website. "Order" means your request to purchase Products from us. "Contract" means the legally binding agreement between you and us for the sale and purchase of Products.

3. Use of the website

You must be at least 18 years old to make a purchase on this website. By placing an order, you confirm that you are at least 18 and legally able to enter into a binding contract.

You may be required to create an account to place an order. If you do, you are responsible for keeping your account details and password confidential, and for all activity that takes place under your account. Please notify us immediately at info@axelic.com if you believe your account has been accessed without your permission.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

4. Products and pricing

We make every effort to ensure that product descriptions, images, and prices on the website are accurate. However, we do not warrant that all content is free of errors. Product colours may appear slightly different depending on your screen or device.

All prices are shown in British Pounds (GBP) and, where applicable, are inclusive of any taxes that apply to your order. Prices and product availability may change at any time without prior notice, although changes will not affect orders we have already accepted.

In the rare event that a Product is listed at an incorrect price due to a genuine error, we are not obliged to supply the Product at the incorrect price. If we discover such an error after you have ordered, we will contact you as soon as possible to ask whether you wish to continue at the correct price or cancel the order. If we cannot reach you, we will treat the order as cancelled and issue a full refund.

5. Orders and acceptance

When you place an order, you are making an offer to purchase the Products in your basket. We will send you an order confirmation email acknowledging that we have received your order. This acknowledgement does not mean your order has been accepted.

A Contract between you and us is formed only when we send you a dispatch confirmation email confirming that the Products have been sent. We reserve the right to refuse or cancel any order before dispatch, for example if the Product is out of stock, if we identify a pricing or description error, or if we suspect fraudulent activity. If we cancel an order you have already paid for, you will receive a full refund.

6. Payment

Payment must be received in full before your order is dispatched. We accept the payment methods displayed at checkout. By submitting payment details, you confirm that you are authorised to use the chosen payment method. All payments are processed securely by our payment providers, and we do not store your full card details on our systems.

7. Shipping and delivery

Shipping costs, processing times, and delivery estimates are set out in full in our Shipping Policy. Delivery timeframes are estimates and are not guaranteed, as the final stage of delivery is handled by the carrier. Risk in the Products passes to you on delivery.

8. Right to cancel, returns and refunds

You have a statutory right to cancel your order within 14 days of receiving your Products, without giving a reason, in addition to our extended 30 working day return window. Full details of how to return an item, the condition items must be in, who pays for return shipping, and how refunds are processed are set out in our Return and Refund Policy. Nothing in these Terms limits the statutory cancellation and refund rights you have as a consumer.

9. Your consumer rights

As a consumer, you have legal rights in relation to Products that are faulty, not as described, or not fit for purpose. Where the laws of the United Kingdom apply to your purchase, these rights include those under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. These statutory rights are not affected by these Terms or by our Return and Refund Policy, and nothing in these Terms should be read as limiting them.

10. Intellectual property

All content on this website, including text, images, logos, graphics, and design, is the property of Axelic or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or use any content for commercial purposes without our prior written permission.

11. User content

If you submit content to our website, for example a product review or a comment, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with our business. You confirm that any content you submit is your own, is accurate, and does not infringe the rights of any third party or breach any law. We reserve the right to remove any content at our discretion.

12. Acceptable use

You agree to use the website only for lawful purposes. You may not use the website in any way that is unlawful or fraudulent, that damages or disrupts the website or its security, that attempts to gain unauthorised access to our systems, or that interferes with any other user's use of the website.

13. Third party links

Our website may contain links to third party websites. These links are provided for your convenience only. We have no control over the content of third party websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

14. Limitation of liability

We do not in any way exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any breach of your statutory rights as a consumer.

Subject to the above, we will not be liable for any loss or damage that was not foreseeable, for any loss or damage that arises from circumstances outside our reasonable control, or for any business losses, as our Products are intended for private and domestic use only. Our total liability to you for any Contract will not exceed the total amount you paid for the Products under that Contract.

15. Indemnity

You agree to be responsible for any reasonable losses or claims we suffer as a direct result of your breach of these Terms or your unlawful use of the website. This clause does not apply to anything caused by our own negligence or breach, and it does not affect your statutory rights as a consumer.

16. Force majeure

We will not be responsible for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, such as extreme weather, carrier disruption, strikes, failure of utilities, or government restrictions. If such an event occurs, we will contact you and take reasonable steps to minimise any delay.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced by a valid one that most closely reflects the original intention.

18. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, make up the entire agreement between you and us regarding your use of the website and any purchase. They replace any previous agreement or understanding between us on the same subject.

19. Assignment

We may transfer our rights and obligations under these Terms to another organisation, for example if our business is sold. This will not affect your rights under these Terms. You may not transfer your rights or obligations to anyone else without our written consent.

20. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. The version published on the website at the time you place an order is the version that applies to that order. Updated Terms take effect once published and do not apply retroactively to orders already placed.

21. Complaints and dispute resolution

We always aim to resolve any issue quickly and fairly. If you have a complaint, please contact us first at info@axelic.com and we will do our best to put things right. If we are unable to resolve your complaint, you may be entitled to refer the matter to an alternative dispute resolution body or to your local consumer protection authority. This does not affect your right to take legal action.

22. Governing law and jurisdiction

These Terms and any Contract formed under them are governed by the laws of the Netherlands. However, if you are a consumer, you benefit from any mandatory protections of the law of the country in which you live, and nothing in these Terms removes or reduces those protections. As a consumer, you may also be entitled to bring proceedings in the courts of your country of residence.
